What is Title IX?

Title IX of the Education Amendments of 1972 is a federal law that prohibits sex discrimination in education and reads:

“No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.”

The University of Georgia does not discriminate on the basis of sex in its education programs and activities. Prohibited sex discrimination covers sexual harassment, including sexual violence. “Sexual violence refers to physical sexual acts perpetrated against a person’s will or where a person is incapable of giving consent due to the victim’s use of drugs or alcohol, or due to an intellectual or other disability. Sexual violence includes rape, sexual assault, sexual battery and sexual coercion. All such acts of violence are forms of sexual harassment covered under Title IX.”

What is the Sexual Misconduct Policy?

The USG is committed to ensuring the highest ethical conduct of the members of its community by promoting a safe learning and working environment. To that end, this Policy prohibits Sexual Misconduct, a form of sex discrimination, as defined herein.

What is Sexual Harassment?

Sexual harassment is unwelcome verbal, non-verbal or physical conduct based on sex, or on gender stereotypes, that is:

  1. Implicitly or explicitly, a term or condition of employment, or status in a course, program or activity; OR
  2. A basis for employment/educational decisions; OR
  3. Is sufficiently severe, persistent or pervasive to:
    1. ​interfere with one’s work or educational performance; OR
    2. create an intimidating, hostile or offensive work or learning environment; OR
    3. interfere with or limit one’s ability to participate in or benefit from an institutional program or activity.

POLICY MEMORANDUM

NOTICE OF NON-DISCRIMINATION UNDER TITLE IX OF THE EDUCATION AMENDMENTS OF 1972, 20 U.S.C. 1681 ET SEQ.

Title IX prohibits discrimination on the basis of sex in education programs or activities operated by recipients of Federal financial assistance. The University of Georgia does not discriminate on the basis of sex in its education programs and activities. Prohibited sex discrimination under Title IX includes sex-based harassment (including sexual harassment, sexual violence and gender-based harassment), harassment and bullying, pregnant or parenting students, athletic opportunities and benefits, and retaliation.

Title IX complaint procedures are found in the University of Georgia Non-Discrimination and Anti- Harassment (NDAH) Policy for complaints against non-students and the Sexual Misconduct Policy for complaints against students.
